Three officials of the Chandigarh Police were booked today on charges of outraging modesty, house-trespass, wrongful confinement, defamation and criminal intimidation, on the complaint of Karnal resident Santosh Kumar, who was wrongly arrested and kept in jail by these men last year.
Chandigarh Police wrongly arrested Santosh Kumar and had allegedly outraged her modesty while in police custody, when they were actually supposed to arrest Santosh Singh, wife of Jeet Singh, also a Karnal resident.
Those booked are Head Constable Ram Kumar, Constable Jasbir Singh and Constable Kulwinder Kaur. A case was registered against the three at the police station in Karnal, on orders issued by the Chief Judicial Magistrate (Karnal) R N Bharti.
According to advocate Des Raj Goel, who filed the petition on behalf of Santosh Kumar, the court took a serious note of the allegations levelled by her and ordered a case be registered against these men.
While Head Constable Ram Kumar is already facing suspension, the other two were posted at Sector 36 police station.
it may be mentioned while the Karnal court has now taken a stern note of the wrongful arrest of an innocent woman by the Chandigarh Police, senior police officers had shrugged off their responsibility by merely suspending a head constable and issuing a censure notice to the SHO concerned, inspector ishwar Singh Mann.
Santosh Kumar, wife of Surjit Kumar, was arrested on November 28 under the provisions of Excise Act and declared a proclaimed offender. in reality, the actual culprit was Santosh Singh who smuggled illegal liquor.
Head Constable Ramkumar and two others Constable Jasbir Singh and Constable Kulwinder Kaur brought Santosh Kumar from Karnal to Chandigarh and kept her in lock-up. She was allegedly sexually harassed in the lock-up by Ram Kumar.
The next day she was produced in the court and sent to judicial custody. She was kept in Burail jail for 14 days, till she was released on bail.
